Seeing this employer was on the news a couple weeks back under paying some workers who went on strike for 24 hours

But if they say I'm refusing to work I haven't been medically cleared yet to return .
Epilepsy I've had three CT scans since my brain injury. I saw a neurosurgeon last Monday not once did a specialist say Micky you have epilepsy.

Once again why do two companies who are not paying my wages scream blue murder .
I'm not even getting benefits why are they pushing so hard
Why no gradual return
Why must I be 100 percent last Monday I was told me and my employer must accept at this stage I can't do manual labour
What will they say to that

Let's say today was a waste
My lawyer was held up in court so we had the tribunal over the phone .
Seems them getting medical information on me isn't happening my GP only released medical info on the accident they want everything they have on me .
Royal Adelaide hospital are dragging their feet sending
any info at all . I told the lawyer today I was there last Monday and later today .
So my lawyer told me today no one is saying I'm not injured not in pain etc etc etc ,
This is now a legal issue if it's work cover or not .
While talking to my lawyer Centrelink sent me a text wanting proof of my ID again
How many times can I give them my birth certificate and my proof of ID card
So a waste again

Ok that could be called Black Tuesday
Tribunal wasn't great lawyer was held up .
My medical records have issues GP released notes re my injury the legal lady was upset she is summoning all my medical records from her clinic not many there truthfully
And the Royal Adelaide is dragging its feet with my records .
And I was told today the tribunal is not over my injury my pain and what I've lost . It's a legal thing whether it's work cover cause work and insurer are saying it was a work social and not work .
Then this afternoons ENT appointment they lost my second appointment months ago complained I didn't take the CT scan in last week they complained I had one .
I'm not saying what they found and think I may have its supposedly not contagious but I was alone in a room with four women today One touched my arm.
But 6 months to tell me next month an MRI
Assuming I don't need to be in hospital
If I do I've infected my family and so many people

Centrelink arrgghh ill let you guys know when i know WTF is going on

Ok social worker has advised me I'm on incapacitated benefits.
Now I need to get the GP to do a certificate from late April for 91 days
I can't go back for 8 hours yet and if I've got what they think in my brain may not be wanted back

Done I'll take the certificate into Centrelink next week .
I'll be truthfull work and their insurer can go on and on .
I dont care either it is or isn't work cover
But going through my medical records will not show I've had epilepsy or the plague .
And it's what it is an accident not caused by anything else other than a door hitting my face and the floor hitting the back of my head .
End result traumatic brain injury 6 fractures healing takes 2 years I may never be 100 percent
All this legal stuff can't really deny an accident

Mind you being missing for 30 minutes didn't help I was covered in blood and did almost pass away .

Ok quick update
Centrelink has approved me being incapacitated. I do have an assment appointment late March I'll take someone in with me to make sure everything's good and I don't forget stuff
Busy day today lawyers appointment
And then bus trips to hampstead

Just another quick update
Not much I can really say except I had a meeting with my lawyer . Work is still saying I had a medical episode before the door hit me . They stopped saying I was drunk paramedics took blood which showed I was sober .
A witness statement backs up a door hit my face floor hit my head . But he also says I came out of the toilet unstable eyes rolling he says I was drunk or high .
Work even though that night the hospital took blood diabetes was normal nope they are trolling my medical records trying to find as I understand it epilepsy.
Never ever had that it been diagnosed.
Lawyer saying one of two things .
What I tell you is it will go to court ,

I'm still at that stage all I want besides getting healthy is find out is a work function work or not work .
That's the big thing work is saying I didn't need to be there I wasn't offically invited even though a office worker walked around asking 51 staff members.

It's a return to work tribunal I'm not refusing to return to work ( they might say that ) I haven't been medically cleared . And as I understand it they want me 100 percent fit and healthy if it's not workcover that's their legal right .
Meanwhile I may get to 75 percent right or less

if you stole someones wallet at this ''work function'' would it be classed as stealing at work or at a private party ?....if work you'd face the sack, if not they shouldn't or wouldn't know about it

if you pinched a girl on the bum at this ''work function'' & she didn't like it, is it sexual harassment in the work place or a bloke trying to seduce a woman at a private party ??

Tuesday I got a work asessment at Centrelink my nominee can't attend
I've been warned what they will ask told my eldest who is going with me .
Honestly I think being a drunk or druggie I'd be on disability being honest and a brain injury victim it's not that easy .
Oh well I'll get there

Ok quick update nothing is going on at present .
I've had to change a specialist appointment to attend a tribunal hearing later this month .
Therapists are working towards returning me to work on a gradual return or light duties ( whatever u wish to call it ) . And work is saying it's not work cover can't return until he's a 100 percent and they refuse to move me to a job that will be easier for me to return to .
Of course that raises two questions
1 if it's not work cover I get to 75 percent can I return .
2 if it is work cover I can't do 8 hours a day manual will they give me another job .
So other than another coworker trying to find out what's going on nothing much is . Yes I saw the messanger message still no idea why an employer keeps getting employees to ask about me .
Oh well didn't reply
Still I am getting a small amount of money on incapacitated benefits would have got help sooner except the insurer refused to say yes or no for months .

Ok I have a therapy session in 30 minutes for an hour then 45 minutes later I'm off to see a neurolgy doctor .
The work tribunal is saying I must see this doctor as my employer and their insurer are insisting I have a brain disorder I have never ever ever ever ever ever been diagnosed with in the 53 years of my life .
And if I've had this disorder in the 21 years I've worked there wouldn't you think it would have come up at sometime . This may well cost me thousands or my employer or their insurer ,
Honestly I had an accident that one or two more millimetres would have killed me .
Yet my employer is making it feel like they nearly died

Quick update
That specialist appointment cost my employers insurance company a heap of money to find nothing out .
Due to my memory loss he could not back up the witnesses statement and seeing I've never had seizures he couldnt say I had one at the work function

I've been thinking today and yes that hurts me lol .
I've been a nice person talking nicely doing everything the tribunal is ordered to tell me , no issue I'll go to hell and back if it's decided .

But really send me to a specialist to back up an ethnic Indians ( no offence meant ) who is on a large wage at my company because he saw my eyes roll me appear drunk and the accident happen . Yes thank you for calling an ambulance. But honestly he said I was drunk or high honestly the paramedics took blood which should I was sober . 21 years I've worked for them yes I'm a **** kicker no one knows I don't drink really .
But still claiming he was correct making me see a specialist  . And the specialist yeah right he can't say the witness is correct because the blood test says otherwise I've never ever ever had epilepsy they are trying to say I have their expert says rolling eyes does not prove that .

So thinking is bad but why are they screaming blue murder they aren't paying me a wage , they demanded I get benefits . Two issues one from rehab that was sorted it took months and months for the insurance company to say no ( still only told my lawyer ).

I understand they are trying to get me back to work not paying me money . But they will not allow me to return until I'm 100 percent I've been told I may get to 70 or 80 percent ,
Yet work insurer are fighting but saying that yet implying I'm refusing to return .
I'm not medically cleared yet

Ok update
Today was a two session therapy day with a lawyer meeting thrown in .
First therapy involved walking to supermarket and on paper marking products in order . Ok started it earlier in the week after 20 mins I couldn't do it . Today was the same walk do the remainder of the asiles .
At the 30 min mark I had an almighty head spin grabbed hold of a shelf so I didn't fall . Therapist said she couldn't see my body go funny then she saw my face .
Had to sit down for 5 mins then walk home finally in front of one I had a head spin . They couldn't say it was normal every time something happens that say it's fine .
So resting my head hurts like hell I cancelled the speech therapy so I could rest .
Booked a taxi so I don't have to walk to the bus home I'll catch a bus .
Not that I wanted a head spin but in front of a therapist I'm tired of hearing
1 that's normal to wander left or right walking
2 you have great balance you don't fall down when u get wobbly
3 one therapist I've had wobble issues he's nope no you haven't no ones ever seen it well my son has before

I'm over the positives MRI next week see if that answers the bubble behind the ear drum question

This is just a bit funny for me . Yes I'm going to footy it wears me out Monday's seem I'm tired .
Ok I have a busy therapy section tomorrow. It's my weekly or fortnightly trip to hampstead .
Recreational therapist went with me on the bus to see the aboriginal shield exhibition. Ok I didn't check the bus time we got there paid got in looked at it read the plaques. Was good needed to catch the bus back but I said do you wanna see the free exhibits um no time to get the bus off we go.
Now he says I've checked your program tomorrow yep I'm busy almost three hours at hampstead . Could I pick you up take you to a brain injury meeting well I'd like to go but I've got three hours of therapy . I could pick you up he kept pushing so you'd drop me to hampstead no no can your son pick you up . I ended up saying it's a bit hard do two hours I didn't say no lunch get picked up driven to hampstead for three hours .
If he wants me to go why wait until I'm busy at hampstead.
Then it was an afternoon walking on the beach why not Michael I'm in the work tribunal that day lol .
Honestly this one wants to know where I wanna go on a bus due to not being able to drive at present no where lol your talking to a guy whose worked one job for almost 22 years after they changed starting time to 6.30 am years ago all I've done is go to work come home tired .
Sorry but push me to do extra stuff take me to a supermarket to push my brain I almost collapsed and you lot work with brain injured people lmao

Even if it's decided it's not workcover I still need to get healthy and have tests done

Plus it might answer why the head pain never leaves

And my employer is yelling I can't attend if I'm not 100 percent and are taking me to court .

Your highly paid employee says I was walking drunk or high or having a siezure he heard my head hit the floor but couldn't catch me after I walked past him.
He had to get help to save me a highly paid pharmacist sounds fishy .
Go through all this to prove I didn't get injured at work but a work function and go against blood taken by paramedics.
Demand I return to work then say you can't if your not 100 percent

Now the blood test proved I was so sober not high

Makes you think what are they hiding seems they've told a highly paid Indian worker what to say I can't prove that but the lawyer says his statement is suspect he heard my head hit a door but was washing his hands couldn't stop my head thumping the ground .
A highly paid pharmacist could not do CPR he didn't have his phone seems like a stage .

You can't fight bayman they are being like old style bosses everything is fine unless something goes wrong like this . Now scream until it goes away .
So they are dragging me to court
They are sending me I understand to another specialist not a doctor some neuro physio
They aren't believing I'm not 100 percent improved on a 2 year injury
They are screaming they don't have the MRI results they could have got them legally they stopped me attending the apointment
I got nothing to loose I'm on incapacitated benefits
They have employed people since I got injured
Screaming to get me back

Screaming because I'm not working I'm on unpaid leave they have that ability to let people off on unpaid leave but scream blue murder .
I stood next to a coworker who's husband made her take unpaid leave head office approved it came back she had strips torn off her cause the manager said he would not allow her the time off .

I said I can stop an entire ethnic race stop buying from the Kellyville nsw store he said no .
I've gotten friends in vic and SA told them to stop being over charged go to chemist warehouse . If I'm working I get over charged 25 percent off cheaper at chemist warehouse
